Up to 1/2 of the applications submitted for contributions due to compulsory closures or due to a fall in sales contained formal errors. Even a formally correctly submitted application does not automatically mean that the applicant is entitled to the allowance. The applicant must satisfy a number of conditions in order to be entitled to the allowance at all.
Conditions for granting the allowance
In addition to the conditions specific to the maintenance allowance for compulsory closure and for the contribution in the case of declining turnover, the firm or self-employed company must generally meet the following conditions:
- creation of the company or the start of operation of the business had to be no later than 01.02.2020
- company or self-employed persons must not be a firm in difficulty as of 31.12.2019
- tax and levy obligations and no financial obligations payable to the Employment Office and no outstanding claims against employees are fulfilled
- the illegal employment ban in the period of 2 years prior to the submission of the application for
- no bankruptcy, liquidation,receivery administration
It is particularly difficult to assess whether the employer falls into the category of compulsory closure and whether, as of 31 December 2019, the employer is a company in difficulty. Assessing compliance therefore requires increased attention, expertise and experience.
Negative effects on an incorrect application
Although the State will draw attention to a formally incorrect application and, once these formal errors have been corrected, the State will check retrospectively whether the applicant was even entitled to the allowance.
If it later emerges that the applicant has not fulfilled the conditions for granting the allowance, he will not only have to pay back the contribution, but may also have criminal consequences for him (fraud, subsidy fraud, damage to the European Communities' financial interests).
